<p><br /> Who says Apple doesn't listen? More to the point, who says Steve Jobs isn't aware of the rumors? Earlier today Apple <a href="http://www.apple.com/pr/library/2009/01/05sjletter.html">posted a letter from CEO Steve Jobs</a> indicating precisely what has been causing his weight loss (a hormone imbalance, apparently treatable) and why he won't be at the keynote (he's spending time with his family). There's a <a href="http://www.apple.com/pr/library/2009/01/05bod.html">corresponding statement from the Apple board of directors</a> offering support for Steve and confidence in his continued leadership.<br /> <br /> Steve's no dummy. I applaud him taking this time to be with his family, and I'm personally quite happy to hear his weight loss appears to stem from a rather strange but reversible affair. While the keynote will be odd without him, let's hope this puts a little water on the doomsayers out there. Note that registration isn't a condition of protection, but it is a condition of certain types of infringement actions and damages.<br /></p>
<p>Psystar argues, thus, that since Apple doesn't own the copyright, there's no way for Apple to enforce its claims that Psystar violated its copyright. The claim was filed in U.S. District Court last week.</p>
<p>Although <a href="http://cocatalog.loc.gov/cgi-bin/Pwebrecon.cgi?v1=2&amp;ti=1,2&amp;Search_Arg=Mac%20OS%20X&amp;Search_Code=TALL&amp;CNT=25&amp;PID=VZJcV9sU7jQZwCQO8ZEjBBQ1uB&amp;SEQ=20081222170605&amp;SID=5">copyright registration number TX0005401457</a> describes a "computer program" named Mac OS X, it's unclear how Psystar argues this isn't the copyright Apple owns on its operating system. Moreover, contrary to what Psystar appears to argue, copyright is secured automatically in the United States when the work is created, and registration is not a condition of copyright protection (although it can help in fighting infringement). Our Engadget colleague Nilay Patel <a href="http://www.engadget.com/2008/12/23/psystars-lawyers-take-another-hit-say-apple-didnt-copyright-o/">sums up this latest Psystar legal stratagem as "desperate.</a>" Plus, you can file suit while registration is pending, so even if there was some technical defect in the Mac OS X registration, Apple could fix it while pursuing its lawsuit.</p>
<p>If this long shot claim were true, it could undermine Apple's ability to restrict third parties from selling generic clones that run Mac OS X. The back-and-forth arguments are part of a lawsuit Apple originally brought against Psystar for selling Mac OS X with its clones, allegedly in violation of Apple's license agreement. According to InformationWeek, Apple now suspects that a larger company interested in selling Mac OS X-compatible computers is bankrolling Psystar's legal battle.</p>

Orange is a subsidiary of France Telecom. </p>
<p>In September, Orange competitor Bouygues Telecom SA filed a complaint with the Competition Council about the exclusivity agreement. While a decision hasn't been reached on the merit of Bouygues' argument, today's order was a "protective measure" as the Council continues its investigation, likely to take a year or more. </p>
<p>Both SFR (the second-largest carrier in France) and Bouygues Telecom (the third largest) hope to begin selling the handsets soon.</p>
<p>In a statement, the Competition Council said that the Apple-Orange agreement posed a "serious and immediate threat" to competition among carriers, and higher costs for customers.</p>
<p>France Telecom plans to appeal the decision. </p>

<p>Also, Steve Jobs will not be giving the keynote address, handing that honor to Phil Schiller, senior VP of worldwide product marketing. It will be Apple's final keynote address at the event.</p>
<p>In <a href="http://www.apple.com/pr/library/2008/12/16macworld.html">a press release</a>, Apple said it has scaled back its presence at other trade shows, including NAB, Macworld New York, Macworld Tokyo, and Apple Expo in Paris.</p>
<p>This will be the 25th Macworld Expo. Steve Jobs had given the keynote address since 1997, when he returned to the company as interim CEO.</p>

Apple released two new Get a Mac ads, just in time for the holiday season. The two ads, entitled "I Can Do Anything," and "Tree Trimming," are animated, and very amusing. <br /><br />In the I Can Do Anything ad [<a href="http://movies.apple.com/movies/us/apple/getamac/apple_getamac_i-can-do-anything_20081215_480x272.mov">direct video link</a>], PC shows off what he can do because he is animated. He then talks to a rabbit that is on its way to the Apple Store.<br /><br />In the Tree Trimming ad [<a href="http://movies.apple.com/movies/us/apple/getamac/apple_getamac_tree-trimming_20081215_480x272.mov">direct video link</a>], Mac and PC are decorating a tree. This year, the iPhone is <a href="http://www.time.com/time/specials/2008/top10/article/0,30583,1855948_1863825_1863813,00.html?sr=hotnews">listed at number 3</a> on Time's year-end list, "The Top 10 Everything." I guess it was due for a slip (not that 3rd place on a list counting "everything" is bad!). Second place went to the <a href="http://www.time.com/time/specials/2008/top10/article/0,30583,1855948_1863825_1863812,00.html?imw=Y">Mitsubishi LaserVue 65-inch HDTV</a>, while the Optoma Pico PK-101 sits at the top spot.<br /><br />The Pico, a <a href="http://www.optoma.co.uk/optomapico/index.aspx">pocket-sized projector for the iPod</a>, first <a href="http://www.tuaw.com/2008/11/14/optomas-palm-sized-video-projector-looks-great/">caught our attention</a> in November. Optoma has priced it at $399US and suggested a shipping date of early next year.<br /><br />So what accounted for the iPhone's slip? Since Judge William Alsup's decision to disallow federal antitrust claims against Apple in Psystar's countersuit, <a href="http://arstechnica.com/journals/apple.ars/2008/12/10/new-psystar-claim-omits-antitrust-still-attacks-copyright">Psystar is amending its countersuit</a>, alleging the misuse of copyright based on <em>different</em> antitrust claims. </p>
<p>It boggles the mind. </p>
<p><a href="http://tuaw.com/tag/psystar/">Apple is already suing Psystar</a>, of course, claiming that they are violating Mac OS X's End User License Agreement (EULA). Psystar, in its new set of counterclaims, says that Apple is improperly extending the scope of copyright law to include its argument that Psystar broke the EULA. </p>
<p>Psystar claims that -- while admitting that it can't make arguments based on federal antitrust law -- Apple has "leveraged" the power granted them by the Copyright Act and extended it to lock in users post-sale. This, Psystar says, is unlawfully monopolistic, and makes Apple's copyrights unenforceable.</p>
<p>Psystar is also seeking to prove that Apple's behavior is illegal under California's unfair competition statute.</p>
<p>The judge will decide in January if the new claims can be argued in court.</p>

The Apple website tells us the following about GrandCentral: <br /><br /><em>Grand Central takes full advantage [of the processor cores] by making all of Mac OS X multicore aware and optimizing it for allocating tasks across multiple cores and processors. Grand Central also makes it much easier for developers to create programs that squeeze every last drop of power from multicore systems.</em><br /><br />MacNN is <a href="http://www.macnn.com/blogs/2008/12/09/apple-files-for-grand-central-trademark.html">reporting</a> that Apple applied for a trademark on the name "Grand Central" under USPTO serial number 77626943. They've gotten the Mac community's attention, and Apple's. Of course, Psystar found themselves involved with Apple legal shortly after their announcement. That was no surprise, but this week's news kind of is.<br /><br /><a href="http://www.groklaw.net/article.php?story=20081202230318899">Apple is claiming</a> that Psystar is part of a larger group of individuals or corporations. Here's a quote from the recently amended claim:<br /><br />"<em>...persons other than Psystar are involved in Psystar's unlawful and improper activities described in this Amended Complaint. The true names or capacities, whether individual, corporate, or otherwise, of these persons are unknown to Apple. Consequently they are referred to herein as ... the "John Doe Defendants"...Apple will seek leave to amend this complaint to show the unknown John Doe Defendants' true names and capacities when they are ascertained.</em>"<br /><br />Yikes. What does make sense in light of this accusation, if proven to be true, is Psystar's apparent brashness. When faced with an opponent as high-profile and well-funded as Apple, they've continued to sell machines. Either they're crazy or they've got some serious backbone. <p>Apple now claims Psystar circumvented Apple's copyright protection code, in violation of the Digital Millennium Copyright Act. Apple said in its original filing that Psystar was in violation of the Mac OS X End-User License Agreement, but tacked on this additional charge last week. </p>
<p>The amendment also names 10 "John Does" -- persons who were not part of the Psystar company, but broke the copyright protection scheme. Apple doesn't know who they are yet, but plans to name names when its lawyers find out who they are.</p>
<p>In other Apple legal news, <a href="http://www.google.com/hostednews/afp/article/ALeqM5iu9ZnhoS3KWzLYEGkO78zZQvWF1A">Apple won a trademark infringement case in China</a> against New Apple Concept Digital Technology Co., Ltd., based in Shenzen. Judges decided that the Chinese company had a logo too similar to Apple's. New Ap -- <em>aw, eff it</em> -- NACDTCL was ordered to pay 400,000 yuan (&asymp; US$58,000) to Apple, Inc.<br /></p>

It touts the MacBook's low power consumption, recyclable enclosure and lack of some of the toxins present in other computers.<br /><br />Activist group <a href="http://www.tuaw.com/2007/04/01/greenpeace-at-apple-store-roma-est/">Greenpeace has been pressuring Apple</a> to adopt more environmentally-friendly production methods and materials over the last couple of years, and last month <a href="http://www.tuaw.com/2008/10/16/greenpeace-responds-to-greener-apple-update/">responded favorably</a> to Apple's efforts to go green. <br /><br />Additionally, Apple has <a href="http://www.apple.com/environment/">posted a page</a> to their website describing not only their efforts toward environmental responsibility with the MacBook, but their overall efforts as a company. The lower heat output makes these great little chips for the iMac.<br />
<br />
Additionally, these chips would come with a faster bus, and even run a bit cheaper than the dual core chips Apple is currently using - the 2.33GHz, 2.66GHz and 2.83GHz chips cost $245, $320 and $369, respectively, according to Digital Times. <br />
<br />
The iMac has been the star of many Macworld keynote speeches, and we expect the same this year. See you in January!<br />

Ars Technica is <a href="http://arstechnica.com/news.ars/post/20081118-judge-slaps-down-psystars-antitrust-claims-against-apple.html">reporting</a> that <a href="http://www.tuaw.com/2008/08/27/psystar-countersues-apple/">Psystar's countersuit</a>, which alleged that Apple violated an anti-trust act by tying their operating system to hardware, was thrown out of court. US District Judge William Alsup made the decision, stating that Apple did not, in fact, violate the Sherman Antitrust Act, Clayton Act, or Cartwright Act.<br /><br /><a href="http://www.appleinsider.com/articles/08/11/18/judge_grants_apples_motion_to_dismiss_psystars_counterclaims.html">AppleInsider notes</a> that crucial to Psystar's claim was the definition of the "Mac OS Market." Judge Alsup agreed with Apple's right to sell their OS to their customers with the understanding that it may only be used with their hardware.<br /><br />Last month, Apple and Psystar <a href="http://www.tuaw.com/2008/10/20/apple-psystar-strike-a-deal/">were ordered</a> to undergo "private arbitration and mediation" by the court. As far as we know, Apple still has a case against Psystar for violating the shrink wrap license and trademarks. Yes, nothing says "let's go shopping at 5AM" like a stomach full of tryptophan.<br /> <br /> While Apple has not revealed their Black Friday plans, analyst <a href="http://www.ipodnn.com/articles/08/11/12/apples.black.friday.plans/">Ben Reitzes of Barclays Capital says</a> he expects aggressive pricing to compete with a dismal economy and significant offers from competitors. For instance, some American big box stores are expected to drop PC prices below $300US. How will Apple do it? <a href="http://www.tuaw.com/2008/10/21/apple-up-11-after-q4-conference-call/">Twenty-five billion dollars in cash reserves and no debt</a> certainly helps.<br /> <br /> So go easy on the Schlitz and set your alarms for The Crack of Dawn. There are deals to be had.</p>

<p>The story is a classic HR nightmare. According to <a href="http://apple20.blogs.fortune.cnn.com/2008/11/08/the-papermaster-chronicles-an-apple-vs-ibm-timeline/">a timeline</a> at Fortune's Apple 2.0 blog, once he was offered a "once in a lifetime" position at Apple, Papermaster indicated he was going to resign at IBM. IBM executives then offered Papermaster a "substantial increase" in pay to entice him to stay. Papermaster declined, and quit. </p>
<p>The next day, IBM filed their suit with the Southern District of New York, alleging that Papermaster is in violation of the non-compete clause of his employment contract. </p>
<p>Papermaster claims in a counter-filing that Apple and IBM are in two totally different businesses: The former a consumer products company, the latter a high-end server manufacturer. <em>Uh huh.</em> </p>
<p>Pundit Robert X. Cringely <a href="http://www.pbs.org/cringely/pulpit/2008/pulpit_20081107_005502.html">speculates</a> that tapping Papermaster for the iPod/iPhone job was duplicitous, and Apple intends to move Papermaster into the lead position at the newly-acquired PA Semi division once the yearlong non-compete clause of his IBM contract expires. </p>

<p>iPod division senior vice president Tony Fadell and his wife, Danielle Lambert, vice president of human resources, will "reduce their roles" at Apple. Lambert will stay until the end of the year to transition to a successor. </p>
<p>"Tony and Dani have each made important contributions to Apple over the past eight years. We're sorry to see Dani go, and are looking forward to working with Tony in his new capacity," said Steve Jobs in the press release.</p>
<p>Former IBM chip executive Mark Papermaster will be joining Apple later this month to replace Fadell, and will gain the new title of Senior Vice President of Devices Hardware Engineering. He's expected to bring his 25 years of experience to Apple's server technologies, as well.</p>
<p>Papermaster unfortunately arrives with some baggage: <a href="http://news.cnet.com/8301-13579_3-10079494-37.html?part=rss&amp;tag=feed&amp;subj=News-Apple">IBM filed suit against Papermaster</a> attempting to forbid him from taking his knowledge of the Power chip architecture to other companies.</p>
<p>IBM said in a statement to CNET that "Mr. Papermaster's employment by Apple is a violation of his agreement with IBM against working for a competitor should he leave IBM. We will vigorously pursue this case in court."</p>

How so? According to Boston.com, it's the hype that sustains us.<br /><br />"...<em>while Apple has made its name combining sharp design with great technology, the brand's true appeal comes from the fact that consumers are hooked on the hype</em>."<br /><br />Us? Succumb to the hype? It's not like we <a href="http://www.tuaw.com/photos/unboxing-apple-tv/191711/">post pictures of empty boxes</a>, <a href="http://www.tuaw.com/2007/06/26/iphone-line-forming-in-nyc/">sleep on the street</a> or buy <a href="http://www.tuaw.com/2005/02/24/podbrix-strikes-again-with-lego-steve-jobs/">Steve Jobs Lego figures</a>. I agree that the fanatical devotion of what Boston.com calls "the iCult" gets way out hand. Is any phone worth three nights on a New York City street? Of course not. But ask those folks why they're there, and they'll tell you it's the fun of hanging out with like-minded Mac geeks. <br /><br />While Apple hypes their products, it's often the fanboys who push it over the edge. <p>Proposition 8 seeks to amend California's constitution to eliminate the right of same-sex couples to marry. A "no" vote on the measure means marriages between same-sex couples would continue to be valid in California.</p>
<p>"Apple was among the first California companies to offer equal rights and benefits to our employees' same-sex partners, and we strongly believe that a person's fundamental rights -- including the right to marry -- should not be affected by their sexual orientation," the statement read.</p>
<p>"Apple views this as a civil rights issue, rather than just a political issue, and is therefore speaking out publicly against Proposition 8."</p>

<p>Continuing with their <a href="http://www.tuaw.com/2008/10/19/new-get-a-mac-ads-bean-counter-and-v-word/">recent bashing</a> of Vista, Apple has released yet another "<a href="http://tuaw.com/tag/Get a Mac">Get a Mac</a>" ad. In Bake Sale [<a href="http://movies.apple.com/movies/us/apple/getamac/apple_getamac_bakesale_20081020_480x272.mov">direct video link</a>], PC is selling bake goods to raise money in order to "fix Vista." Mac asks why, and PC goes on to explain that the marketing team decided to run an "expensive ad campaign instead of fixing Vista." Mac then offers to help out by buying a cupcake ... a 10 million dollar cupcake. <br />

If there was any doubt about these ads being a response to the <a href="http://www.tuaw.com/2008/09/19/analysis-microsoft-offers-im-a-pc-retort-that-falls-flat/">Microsoft ads</a>, this one should definitely settle it. In our <a href="http://www.tuaw.com/2008/10/19/new-get-a-mac-ads-bean-counter-and-v-word/">last post</a>, we took a poll to see if anyone was tired of these Get a Mac ads -- currently 58.2% of the people that voted say they still like them. <br />
